Agreement to these terms

Welcome to connernielsenrealestate.com (the “Site”), operated by Conner Nielsen, a licensed Texas REALTOR® sponsored by Close Real Estate (broker John Hill) in Fort Worth, Texas. By accessing or using the Site, you agree to these Terms & Conditions (the “Terms”). Please read them carefully and keep a copy for your reference. If you do not agree with these Terms, please do not use the Site.

The Site is a real estate marketing site. It is used to share information about Conner Nielsen’s real estate services and to help prospective buyers and sellers connect with Conner.

Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use information. By using the Site, you acknowledge and agree to the practices described there.

Electronic communications

When you visit the Site, submit a form, or email us, you are communicating with us electronically and consent to receive communications from us electronically. You agree that any notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

Text messaging (SMS)

We use SMS to confirm appointments, send reminders, and notify clients of schedule updates or important changes.

You can cancel the SMS service at any time. Just text “STOP”. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again.

If you are experiencing issues with the messaging program, you can reply with the keyword “HELP” for more assistance, or you can get help directly at conner@closereal.com.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

No real estate relationship created

Information on the Site is provided for general informational purposes and does not constitute legal, financial, or tax advice. Using the Site, submitting a form, or scheduling a consultation does not by itself create an agency, brokerage, or client relationship. A representation relationship begins only when you and Conner Nielsen enter into a written agreement. Property details, market figures, and the terms of any guarantee are subject to verification and may change.

Acceptable use

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site in accordance with these Terms. You agree not to use the Site for any unlawful or prohibited purpose, and not to use it in any way that could damage, disable, overburden, or impair the Site or interfere with anyone else’s use of it. You may not attempt to gain access to any materials or information through means not intentionally made available through the Site.

Intellectual property

All content on the Site, including text, graphics, logos, images, and the design and arrangement of that content, is the property of Conner Nielsen, Close Real Estate, or their suppliers and is protected by copyright, trademark, and other laws. You may view and use the content for your own personal, non-commercial use only. You may not copy, modify, publish, transmit, reverse engineer, sell, or create derivative works from any content on the Site without our prior written permission, and you acquire no ownership rights by using the Site.

Links to third-party sites and services

The Site may contain links to, or content from, websites and services operated by others, such as our online scheduler, video platforms, and analytics tools (“Linked Sites”). These Linked Sites are not under our control, and we are not responsible for their content, accuracy, or practices. We provide these links only as a convenience, and including a link does not imply our endorsement of the linked site or its operators. By using a third-party service through the Site, you may be sharing your information directly with that provider.

International users

The Site is controlled and operated from within the United States. If you access the Site from another location, you do so on your own initiative and are responsible for complying with all applicable local laws.

Indemnification

You agree to indemnify, defend, and hold harmless Conner Nielsen and Close Real Estate, along with their respective officers, agents, and affiliates, from any claims, losses, costs, liabilities, and expenses (including reasonable attorney’s fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party or any applicable law.

Arbitration

If a dispute arises out of or relates to these Terms and cannot be resolved informally, you and Conner Nielsen agree that it will be settled by final and binding arbitration under the Federal Arbitration Act, conducted by a single neutral arbitrator administered by the American Arbitration Association or a similar service the parties select, in a mutually agreed location. The arbitrator’s decision will be final, and judgment may be entered on it in any court with jurisdiction. The prevailing party in any arbitration or related proceeding is entitled to recover its reasonable costs and attorney’s fees. This provision survives the termination of these Terms.

Class action waiver

Any arbitration will take place on an individual basis only. Class arbitrations, class actions, and representative or collective proceedings are not permitted. You and Conner Nielsen agree to bring claims against each other only in an individual capacity, and the arbitrator may not consolidate more than one person’s claims or preside over any class or representative proceeding.

Disclaimer of warranties and limitation of liability

The Site and its content may contain inaccuracies or typographical errors and may be updated at any time. The Site and all information, products, and services on it are provided “as is” and “as available,” without warranty of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the maximum extent permitted by law.

To the fullest extent permitted by law, Conner Nielsen and Close Real Estate will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages of any kind arising out of or connected with your use of, or inability to use, the Site or its services. Because some jurisdictions do not allow certain limitations of liability, parts of this section may not apply to you. If you are dissatisfied with the Site or these Terms, your sole and exclusive remedy is to stop using the Site.

Termination and governing law

We may, in our sole discretion and without notice, suspend or terminate your access to the Site or any part of it at any time. These Terms are governed by the laws of the State of Texas, and you consent to the exclusive jurisdiction and venue of the courts located in Texas for any dispute arising out of or relating to your use of the Site. No joint venture, partnership, employment, or agency relationship is created between you and Conner Nielsen by these Terms or your use of the Site.

If any part of these Terms is found to be invalid or unenforceable, that part will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force. These Terms make up the entire agreement between you and Conner Nielsen regarding the Site and supersede any prior understandings on that subject.

Changes to these terms

We may update these Terms from time to time at our discretion. The most current version will always be posted here and will supersede earlier versions. We encourage you to review these Terms periodically so you stay informed of any updates.
